What Does a Business Going into Administration Mean?

Do you need advice on a business going into administration? Administration is a formal insolvency process which can be used to save a viable business.

It basically provides a moratorium (period of time when you won’t be chased to pay your debts) when creditors cannot take action in order to allow the administrator to trade the business whilst either rationalising to allow the business to continue trading, or whilst looking for the business to be sold to new owners.

Administration

Yes, administration does not automatically mean your business will be broken-up and sold off, in fact the law states that the first objective an administrator should look to, is rescuing the company as a going concern. However, if that is not possible, administration is sufficiently flexible to allow for a variety of outcomes.

If your company is a limited liability company, then normally you won’t be held liable for its debts unless you have personal guarantees. And just to be clear, because you’ve been the Director of a business that has gone into administration, this does impact your ability to be a Director of other / future businesses either.

That’s a difficult question, but generally the key to preventing an administration is to seek help as soon as possible. We detail elsewhere on this website options to be explored, but each requires a little time – so we advise that businesses get in touch as soon as possible and we’ll work towards finding the right solutions on how we can help you and your business. But also, don’t forget, going into administration is not the end – businesses can be restructured, rescued or even sold after an administration.
